Please read these Terms of Service ("Terms") carefully before using the Push Performance Training website or purchasing any of our services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. ABOUT US
Push Performance Training ("we", "us", "our") is an Australian-based online fitness and performance coaching business. We offer online coaching, training programs and plans, and nutrition plans to clients Australia-wide and internationally.
2. SERVICES
We provide the following services (collectively, "Services"):
Online Coaching: Personalised, ongoing coaching delivered remotely via our platform, email, video calls, or messaging apps.
Training Programs & Plans: Structured digital training programs and periodised plans provided as downloadable or accessible digital content.
Nutrition Guides: General nutrition guidance and meal planning frameworks provided for general health and performance purposes only. Nutrition content is provided as educational guides and does not constitute personalised dietary advice from a registered dietitian or nutritionist.
The specific scope, deliverables, and duration of each Service will be confirmed at the time of purchase or in a separate service agreement.
3. ELIGIBILITY
By purchasing or using our Services, you confirm that:
You are at least 18 years of age, or have obtained written consent from a parent or legal guardian;
You are legally capable of entering into a binding contract; and
You will provide accurate and complete information when registering or purchasing.
4. HEALTH & MEDICAL DISCLAIMER
Important: Push Performance Training is not a medical or healthcare provider. Our coaches are fitness professionals, not registered medical practitioners, dietitians, or allied health professionals.
The information, coaching, and training programs we provide are for general fitness and performance purposes only and do not constitute medical advice, diagnosis, or treatment. Our nutrition content is provided as general guides only and does not constitute personalised dietary advice from a registered dietitian or nutritionist. You should consult a qualified medical professional or registered dietitian before making significant changes to your diet or exercise routine, particularly if you have a pre-existing health condition, injury, or medical concern.
You participate in all training and follow all nutrition guidance entirely at your own risk.
5. YOUR RESPONSIBILITIES
You agree to:
Provide honest and accurate information about your health, fitness history, goals, and any injuries or conditions that may affect your ability to train;
Immediately inform us of any changes to your health status or if you experience pain, discomfort, or injury;
Follow the programs provided as intended and seek clarification if anything is unclear;
Not share, resell, or distribute any programs, plans, or content we provide to you; and
Comply with all applicable laws when using our Services.
6. PAYMENT & PRICING
All prices are displayed in Australian Dollars (AUD) unless otherwise stated. Prices are inclusive of GST where applicable, in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
Payment is due at the time of purchase or as otherwise agreed in writing. We accept payment via the methods listed on our website. You are responsible for ensuring payment details are accurate and up to date.
We reserve the right to change our pricing at any time. Price changes will not affect Services already purchased.
7. REFUNDS & CANCELLATIONS
Our refund and cancellation policy is as follows:
Digital programs and nutrition plans: Due to the digital nature of these products, we generally do not offer refunds once the program or plan has been delivered or accessed. If you experience a technical issue preventing access, please contact us promptly and we will work to resolve it.
Ongoing online coaching: You may cancel ongoing coaching by providing at least 7 days' written notice prior to your next billing cycle. No refunds will be issued for the current billing period already paid.
Consumer rights: Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). If a Service is faulty or not as described, you may be entitled to a remedy under Australian Consumer Law.
8. INTELLECTUAL PROPERTY
All content provided through our Services — including training programs, nutrition plans, coaching materials, videos, documents, and website content — is the intellectual property of Push Performance Training and is protected by Australian and international copyright laws.
You are granted a limited, non-exclusive, non-transferable licence to use the content for your personal, non-commercial use only. You must not copy, reproduce, distribute, sell, or create derivative works from any of our content without our prior written consent.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Push Performance Training and its coaches, employees, and contractors will not be liable for any direct, indirect, incidental, special, consequential, or punitive loss or damage arising out of or in connection with your use of our Services, including but not limited to:
Injury, illness, or health complications arising from following a training program or nutrition plan;
Loss of fitness progress, sporting performance, or results;
Loss of data or access to digital content; or
Any reliance on information provided through our Services.
Where liability cannot be excluded by law (including under the Australian Consumer Law), our liability is limited to re-supplying the relevant Service or refunding the amount paid for that Service, at our discretion.
10. PRIVACY
We collect and handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By using our Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy, which is available on our website.
11. MODIFICATIONS TO SERVICES & TERMS
We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice where possible. We may also update these Terms from time to time. The updated Terms will be posted on our website with a revised "Last updated" date. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms.
12. GOVERNING LAW
These Terms are governed by the laws of Australia. Any disputes arising out of or in connection with these Terms or our Services will be subject to the exclusive jurisdiction of the courts of Australia.
